Be Aware of the Risks

During the winter months, when landscaping, lawn mowing, pool maintenance and tree trimming slows down, many operators jump headfirst into the snow removal business.  They have the staff, they usually have the equipment and they have the time.  Landscape companies can often use their existing book of landscape clients to "double dip" and handle their snow removal needs as well.
However, slip-and-fall litigation has changed the game!  More and more corporate entities have extreme contractual conditions that pass all liability to the snow-clearing contractors.  Injuries are are more severe now and the legal system makes it easier to make an injury claim.
In other instances, only verbal agreements exist between the property owner and snow removal operator, leading to arguments not only over liability, but also charges.  For example, a landlord will require snow to be cleared, but won't pay for salting or de-icing, which can lead to hidden ice patches.
To help protect yourself, put the right documentation in place to defend yourself.  Signed contracts listing expectations and services to be provided and how often.  Airtight logbooks of work performed, time it was performed and even pictures.  Finally, make sure the insurance written for your business includes snow removal coverage as a risk.
