Cumberland Ridge Neighbor,
You may have heard that the Cumberland Ridge Homeowner's Association has begun the process of updating our current covenants to better reflect the needs of the neighborhood. These changes will have a positive impact on the long-term appearance of our community and allow there to be consistent enforcement of the covenants. Below is the proposed change to the covenants:
"All professional fees and costs incurred by the Association to correct non-compliance of this declaration shall be the responsibility of the Owner or Owners determined to be in violation. Such fees may include but are not limited to legal expenses, administrative expenses and Executive Officer expenses. Said fees shall be paid to the Association by the Owner or Owners within thirty (30) days of receipt of notification from the Association. Non-payment of said fees within the thirty (30) day payment period will result in a lien begin place upon the Lot of the Owner or Owners until payment is received. The Association will also be entitled to recover from the Owner or Owners any and all additional attorney fees and costs associated with the recording or releasing of any lien.
The Board of Directors of the Association may waive any expense and allow for an appeal process to any violator of this declaration."
Currently, any fees associated with enforcing the covenants falls upon the Association. This has amounted to thousands of dollars over the past few years. This comes out of your annual Association dues, which could be used for improvements and additions to our neighborhood.
Here is a link to schedule your meeting with a Board of Director's member to discuss the covenant change and sign the appropriate document. All individuals listed on the deed to the property need to be present to sign the covenant change.
